Introduction

Supercricket, hereinafter referred to as 'The Platform,' encompasses mobile applications and websites, offering an online gaming experience with skill-based game Fantasy Cricket. Owned and managed by WEBSONIC IT SERVICES PRIVATE LIMITED, referred to as "Supercricket," "We," "Our," and "Us," the term "User," "You," and "Your" applies to any eligible person accessing our Platform, bound by these terms of use.

Acceptance of Terms And Conditions

These Terms apply to everyone who browses or uses the Platform, accesses, downloads, or uses any service on the Platform, becomes a Registered User, or becomes a Registered User.

Please carefully review these Terms periodically before using the Platform or participating in a contest, as Supercricket reserves the right to modify them at any time without prior notice. In case of material modifications, a notice will be prominently posted on this page with the effective date. Your continued use implies consent to the changes. Failure to agree results in the termination of your authorization to use the Platform. Any breach of these Terms automatically terminates your authorization.

Eligibility

To create an authorized account ("Account") and become a Registered User, you must meet the following criteria at the time of registration:

Professional or amateur athletes, sports agents, coaches, team owners, team employees, referees, league officials, and their immediate family members are prohibited from participating in Fantasy contests in the sport with which they are associated.

Legality

Games of skill fall outside the scope of Indian gambling legislations, including the Public Gambling Act of 1867, making them 100% legal in India. The determination of whether a game is a game of skill or chance often relies on the "Dominant factor test," and all the games offered on our Platform are considered "Games of Skill" as skill is the dominant factor in determining the winner.

Therefore, Supercricket provides its Games (Games of Skill) to residents of states that do not fall under 'Restricted States.' By participating in our games, you acknowledge and agree that you are engaging in a Game of Skill and meet the eligibility criteria outlined in these terms.

Intellectual Property Rights

The intellectual property rights pertaining to the Content on the Platform, including games, contests, software, advertisements, written content, graphics, images, illustrations, sounds, marks, logos, animations, videos, and any other content form, are created, owned, and/or licensed by Supercricket, its partners, affiliates, licensors, associates, and/or users. These rights are protected by copyright, trade dress, patent, trademark laws, and other laws safeguarding intellectual property and related proprietary rights. Unauthorized copying or downloading of any content from the Application is prohibited unless expressly authorized in writing by Fantasy Cricket. Users agree to indemnify Supercricket from any unauthorized use of intellectual property.

Users are obligated not to remove or alter copyright, patent, trademark notices, or engage in selling, licensing, distributing, copying, modifying, publicly performing or displaying, transmitting, publishing, editing, adapting, creating derivative works, or making unauthorized use of content. Supercricket retains all rights in the content not expressly granted in these Terms.

Users are solely responsible for any content posted in the interactive areas of the Platform. Users affirm ownership of Intellectual Property Rights in the posted content, asserting that it does not infringe any third-party rights. Users agree not to display or use names, logos, marks, labels, intellectual and proprietary rights, or trademarks/copyrights of any third party on the Platform, indemnifying Supercricket against costs, damages, loss, including litigation costs and counsel fees, arising from third-party claims due to infringement of intellectual property rights by Users.

Supercricket’s Platform may display content not owned by Supercricket, and Supercricket assumes no responsibility for such content; it is the sole responsibility of the person or entity making it available.

Users grant Supercricket and its affiliates, partners, licensors, and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users' Content for:

Usage of The Platform

To access Supercricket's services, create an Account by submitting a valid Indian mobile number and verifying it through a One Time Password (OTP). Each Account is linked to a valid Indian mobile number, and OTP verification is mandatory for each new session on the Platform.

User Conduct

Users are allowed to maintain only one account on the Platform. Operating multiple accounts may lead to suspension or termination, refusal of current or future use, and withholding or forfeiting of prizes and wallet balances.

Users must provide accurate information about themselves and confirm that submitted information solely belongs to them, avoiding misrepresentation.

Misuse of bonus promotions, referral programs, or any other promotional programs offered by Supercricket is prohibited. Fraudulent activities, such as attempting to defraud other users or Supercricket through transfers of winnings, bonuses, or balances between accounts, can result in permanent or temporary account termination and forfeiture of prizes or balances.

Users are prohibited from removing, degrading, deactivating, or altering Platform content. Unauthorized access using robots, spiders, scrapers, or similar means is not allowed. Threatening, coercive, defamatory, harassing, offensive, or illegal conduct may result in account restriction or termination, and forfeiture of amounts or privileges.

Copying, modifying, renting, selling, or transferring any right to the technology or software underlying Supercricket’s Platform is not allowed.

The Platform should only be used for lawful purposes. Unacceptable uses include illegal activities, interference with the Platform, dissemination of offensive material, infringement of intellectual property rights, and engaging in activities against the spirit or intent of the Platform.

Unfair conduct during games, contests, or tournaments, such as falsifying personal information, financial fraud, colluding, or violating contest rules, may lead to the refusal of prizes and benefits. Supercricket may take legal action and seek refunds for illegal or fraudulent use of the Platform.

Users are responsible for the content they post and may be held liable. Supercricket assumes no responsibility for user content but reserves the right to monitor and ensure compliance. User content must not be unlawful, obscene, defamatory, or infringe on intellectual property rights. Users grant Supercricket a license to use their content.

Supercricket reserves the right to remove, screen, or edit user content without notice. Posting personal information is discouraged, and users are responsible for creating backups. Publicly shared information may be collected and used by others, posing a risk. Users are advised to avoid posting personally identifiable information at their own risk.

Rights Of Supercricket

If you violate any of these terms, Supercricket may, at its sole discretion:

In any game or contest played on the Platform, Supercricket reserves the right to announce winners or cancel games and process refunds.

Payments & Withdrawals

In relation to any transactions conducted on the Platform, including participation in Cash Games, you are bound by the following Payment Terms:

Supercricket is not responsible for inaccuracies in bank/UPI details provided by users. Incorrect withdrawals will be refunded to the Wallet, and mistakes in providing bank/UPI details are not Supercricket's responsibility.

Third Party And Sponsored Content

Supercricket’s Platform and/or website may contain links to third-party websites and/or applications. Supercricket does not control these third-party entities and cannot be held responsible for their content. Inclusion of third-party content or links does not constitute an endorsement by Supercricket.

Your interactions with third parties, such as payment providers and KYC verification services, are solely between you and the third party. Supercricket is not liable for any loss or damage resulting from such transactions. Any issues with third-party products or services should be addressed directly to the third party.

Content on Supercricket’s Platform, including third-party content, is not guaranteed for accuracy, integrity, or quality. Supercricket is not responsible for third-party content reliability.

Supercricket may place Sponsored Content on the Platform through partnerships with Sponsored Third Party Partners. The display of Sponsored Content is subject to change without specific notice.

The content on the Platform is for personal, non-commercial use. Sponsored Third Party Partners may use the Platform for commercial purposes. Copying, reproducing, altering, or publicly displaying any content on the Platform is not allowed.

Governing Law, Jurisdiction & Dispute Resolution

These 'Terms of Use' are governed by Indian laws. Users are responsible for complying with local laws.

Supercricket retains the right to seek equitable relief before, during, or after arbitration. Disputes, complaints, etc., are subject to the exclusive jurisdiction of India.

Limitation Of Liabilities And Indemnity

Users access the Platform voluntarily and at their own risk. Supercricket is not liable for any loss or damage incurred during Platform access, Game/Contest participation, or prize acceptance.

Users indemnify Supercricket, its directors, employees, partners, associates, and licensors against liability, cost, loss, or expense arising from Platform access or service use.

Disclaimers & Warranties

Supercricket disclaims responsibility for harm resulting from user participation in Games/Contests/Tournaments, User Content, transactions with third parties, and Platform inaccessibility due to various factors.

While Supercricket strives for error-free and secure Platforms, it does not guarantee meeting user requirements, uninterrupted service, or accurate results. Users are responsible for downloads' consequences.

Supercricket reserves the right to rectify errors, notify users of corrective actions, and limit user services or terminate accounts for intentional disruptions. Unfinished Games/Contests/Tournaments do not guarantee potential winnings. Users are not entitled to demands or claims in the event of Platform, service, event, or Contest suspension or closure.

Changes to T&C

We reserve the right to change these Conditions of Use at any time with the permission of Supercricket.
